Terms of Service

These Terms of Service ("Terms") govern your access to and use of VietSpeaks, including our mobile app, website, and related services (collectively, the "Service"). VietSpeaks is operated by [VietSpeaks], located in Vietnam.

1. Acceptance of Terms

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials. Email verification is required for full access.

3. Subscriptions and Payments

VietSpeaks offers tiered subscriptions: Free (limited sessions), Personal ($4.99/month or $49.99/year), Pro ($9.99/month or $99.99/year), and B2B ($19.99/teacher/month or $199/year + $5/student/month, capped at $999/month/school). Mobile payments are processed via RevenueCat and app stores (Apple App Store, Google Play). Web payments for B2B and teachers are processed via Dodo Payments. Subscriptions auto-renew unless canceled at least 24 hours before renewal. No one-time purchases.

4. User Content

You may submit audio recordings for analysis. You grant VietSpeaks a non-exclusive, royalty-free license to use, store, and analyze this content to provide the Service. Do not submit sensitive or illegal content.

5. Intellectual Property

All content, including phoneme models, UI, and educational materials, is owned by VietSpeaks or licensed. You may not copy, modify, or distribute without permission.

6. Prohibited Conduct

You agree not to: misuse the Service, violate laws, infringe IP, harass users, or attempt to reverse-engineer our ONNX models.

7. Termination

We may suspend or terminate your account for violations. Upon termination, access ends, but obligations survive.

8. Disclaimer and Limitation of Liability

The Service is provided "as is." We disclaim warranties. Liability is limited to subscription fees paid in the last 12 months.

9. Governing Law

These Terms are governed by Vietnamese law.

10. Changes to Terms

We may update these Terms. Continued use constitutes acceptance.

Privacy Policy

This Privacy Policy explains how VietSpeaks collects, uses, and protects your personal information. We are committed to safeguarding your privacy, especially audio data.

1. Information We Collect

• Personal Data: Email, name, role (student/teacher), registration details.
• Usage Data: App interactions, progress, device info (IP, OS).
• Audio Data: Speech recordings for phoneme analysis (processed on-device via ONNX; not stored unless for B2B feedback).
• Payment Data: Handled by RevenueCat/app stores (mobile) and Dodo Payments (web); we don't store card details.

2. How We Use Your Information

To provide the Service (e.g., analyze audio for feedback), manage subscriptions, improve the app (analytics), communicate (FCM notifications), and comply with laws.

3. Data Sharing

We share with: Firebase (storage/auth), RevenueCat (mobile payments), Dodo Payments (web payments), teachers/schools (progress for B2B). No selling data. May share for legal reasons.

4. Data Security

We use encryption, access controls. Audio is processed on-device; anonymized where possible.

5. Data Retention

Retained as needed for the Service; deleted upon account closure. Audio deleted after analysis unless opted-in.

6. Your Rights

Access, correct, delete data via app settings. For GDPR (if applicable): rights to object, portability.

7. Children's Privacy

Not intended for under 13 without consent. Parents can request deletion.

8. Cookies and Tracking

Website uses cookies for analytics; app uses device IDs.

9. Policy Changes

Updates notified via app/email.

Refund Policy

This Refund Policy applies to subscriptions purchased through VietSpeaks. For payments processed via Dodo Payments (web purchases for schools and individual teachers), refunds are handled in accordance with Dodo Payments' refund policy as the Merchant of Record.

1. Mobile App Subscription Refunds (iOS/Android)

Subscriptions purchased through Apple App Store or Google Play Store are subject to the respective store's refund policies. To request a refund, please contact Apple or Google directly through their support channels.

2. Web Subscription Refunds (Dodo Payments)

For web purchases processed via Dodo Payments:

• Refund requests must be submitted within 7 days of the initial purchase.
• Refunds are provided on a case-by-case basis and at the discretion of VietSpeaks and Dodo Payments.
• We may refuse a refund request if there is evidence of fraud, refund abuse, or other manipulative behavior.
• For technical issues preventing access to the service, we will work to resolve the issue or provide a refund as appropriate.
• No refunds are provided for unused portions of subscription periods after the 7-day window.

3. B2B Refunds

Refunds for B2B subscriptions (capped at $999/month/school) are evaluated on a case-by-case basis. Schools and institutions should contact support@vietspeaks.com to discuss refund requests. Partial refunds may be available for annual subscriptions under certain circumstances.

4. How to Request a Refund

Contact support@vietspeaks.com with your order details, including your email address and reason for the refund request. We aim to respond within 3-5 business days.

5. Policy Changes

We may update this policy to align with Dodo Payments' terms and applicable regulations; continued use constitutes acceptance.

Điều khoản Dịch vụ

Những Điều khoản Dịch vụ này ("Điều khoản") quản lý truy cập và sử dụng VietSpeaks của bạn, bao gồm ứng dụng di động, trang web, và dịch vụ liên quan (gọi chung là "Dịch vụ"). VietSpeaks được vận hành bởi [VietSpeaks], đặt tại Việt Nam.

1. Chấp nhận Điều khoản

Bằng cách tải xuống, cài đặt, hoặc sử dụng Dịch vụ, bạn đồng ý bị ràng buộc bởi những Điều khoản này. Nếu không đồng ý, đừng sử dụng Dịch vụ.

2. Đăng ký Tài khoản

Để truy cập một số tính năng, bạn phải tạo tài khoản. Bạn đồng ý cung cấp thông tin chính xác và giữ nó cập nhật. Bạn chịu trách nhiệm duy trì tính bảo mật của thông tin tài khoản. Xác thực email là bắt buộc cho truy cập đầy đủ.

3. Đăng ký và Thanh toán

VietSpeaks cung cấp đăng ký theo cấp: Miễn phí (giới hạn phiên), Cá nhân ($4.99/tháng hoặc $49.99/năm), Pro ($9.99/tháng hoặc $99.99/năm), và B2B ($19.99/giáo viên/tháng hoặc $199/năm + $5/học sinh/tháng, giới hạn $999/tháng/trường). Thanh toán di động được xử lý qua RevenueCat và cửa hàng ứng dụng (Apple App Store, Google Play). Thanh toán web cho B2B và giáo viên được xử lý qua Dodo Payments. Đăng ký tự động gia hạn trừ khi hủy ít nhất 24 giờ trước khi gia hạn. Không mua một lần.

4. Nội dung Người dùng

Bạn có thể gửi bản ghi âm để phân tích. Bạn cấp cho VietSpeaks giấy phép không độc quyền, miễn phí bản quyền để sử dụng, lưu trữ, và phân tích nội dung này để cung cấp Dịch vụ. Đừng gửi nội dung nhạy cảm hoặc bất hợp pháp.

5. Tài sản Trí tuệ

Tất cả nội dung, bao gồm mô hình âm vị, UI, và tài liệu giáo dục, thuộc sở hữu của VietSpeaks hoặc được cấp phép. Bạn không được sao chép, sửa đổi, hoặc phân phối mà không có sự cho phép.

6. Hành vi Cấm

Bạn đồng ý không: lạm dụng Dịch vụ, vi phạm luật pháp, xâm phạm IP, quấy rối người dùng, hoặc cố gắng đảo ngược kỹ thuật mô hình ONNX của chúng tôi.

7. Chấm dứt

Chúng tôi có thể đình chỉ hoặc chấm dứt tài khoản của bạn vì vi phạm. Khi chấm dứt, truy cập kết thúc, nhưng nghĩa vụ tồn tại.

8. Tuyên bố Miễn trừ và Giới hạn Trách nhiệm

Dịch vụ được cung cấp "như hiện tại." Chúng tôi miễn trừ bảo hành. Trách nhiệm bị giới hạn ở phí đăng ký trả trong 12 tháng qua.

9. Luật Áp dụng

Những Điều khoản này được quản lý bởi luật Việt Nam.

10. Thay đổi Điều khoản

Chúng tôi có thể cập nhật những Điều khoản này. Việc tiếp tục sử dụng cấu thành sự chấp nhận.

Chính sách Bảo mật

Chính sách Bảo mật này giải thích cách VietSpeaks thu thập, sử dụng, và bảo vệ thông tin cá nhân của bạn. Chúng tôi cam kết bảo vệ quyền riêng tư của bạn, đặc biệt là dữ liệu âm thanh.

1. Thông tin Chúng tôi Thu thập

• Dữ liệu Cá nhân: Email, tên, vai trò (học sinh/giáo viên), chi tiết đăng ký.
• Dữ liệu Sử dụng: Tương tác ứng dụng, tiến độ, thông tin thiết bị (IP, OS).
• Dữ liệu Âm thanh: Bản ghi âm phát âm để phân tích âm vị (xử lý trên thiết bị qua ONNX; không lưu trữ trừ khi cho phản hồi B2B).
• Dữ liệu Thanh toán: Xử lý bởi RevenueCat/cửa hàng ứng dụng (di động) và Dodo Payments (web); chúng tôi không lưu chi tiết thẻ.

2. Cách Chúng tôi Sử dụng Thông tin Của bạn

Để cung cấp Dịch vụ (ví dụ, phân tích âm thanh để phản hồi), quản lý đăng ký, cải thiện ứng dụng (phân tích), giao tiếp (thông báo qua FCM), và tuân thủ luật pháp.

3. Chia sẻ Dữ liệu

Chúng tôi chia sẻ với: Firebase (lưu trữ/xác thực), RevenueCat (thanh toán di động), Dodo Payments (thanh toán web), giáo viên/trường học (tiến độ cho B2B). Không bán dữ liệu. Có thể chia sẻ vì lý do pháp lý.

4. Bảo mật Dữ liệu

Chúng tôi sử dụng mã hóa, kiểm soát truy cập. Âm thanh được xử lý trên thiết bị; ẩn danh khi có thể.

5. Giữ gìn Dữ liệu

Giữ gìn khi cần thiết cho Dịch vụ; xóa khi đóng tài khoản. Âm thanh bị xóa sau phân tích trừ khi chọn tham gia.

6. Quyền Của bạn

Truy cập, sửa chữa, xóa dữ liệu qua cài đặt ứng dụng. Đối với GDPR (nếu áp dụng): quyền phản đối, tính di động.

7. Quyền riêng tư Trẻ em

Không dành cho dưới 13 tuổi mà không có sự đồng ý. Phụ huynh có thể yêu cầu xóa.

8. Cookie và Theo dõi

Trang web sử dụng cookie cho phân tích; ứng dụng sử dụng ID thiết bị.

9. Thay đổi Chính sách

Cập nhật được thông báo qua ứng dụng/email.

Chính sách Hoàn tiền

Chính sách Hoàn tiền này áp dụng cho các đăng ký mua qua VietSpeaks. Đối với thanh toán được xử lý qua Dodo Payments (mua web cho trường học và giáo viên cá nhân), hoàn tiền được xử lý theo chính sách hoàn tiền của Dodo Payments như là Thương nhân Ghi chép.

1. Hoàn tiền Đăng ký Ứng dụng Di động (iOS/Android)

Các đăng ký mua qua Apple App Store hoặc Google Play Store tuân theo chính sách hoàn tiền của cửa hàng tương ứng. Để yêu cầu hoàn tiền, vui lòng liên hệ trực tiếp với Apple hoặc Google qua kênh hỗ trợ của họ.

2. Hoàn tiền Đăng ký Web (Dodo Payments)

Đối với mua hàng web được xử lý qua Dodo Payments:

• Yêu cầu hoàn tiền phải được gửi trong vòng 7 ngày kể từ lần mua đầu tiên.
• Hoàn tiền được cung cấp trên cơ sở từng trường hợp và theo quyết định của VietSpeaks và Dodo Payments.
• Chúng tôi có thể từ chối yêu cầu hoàn tiền nếu có bằng chứng gian lận, lạm dụng hoàn tiền, hoặc hành vi thao túng khác.
• Đối với vấn đề kỹ thuật ngăn cản truy cập dịch vụ, chúng tôi sẽ làm việc để giải quyết vấn đề hoặc cung cấp hoàn tiền khi thích hợp.
• Không hoàn tiền cho phần chưa sử dụng của kỳ đăng ký sau thời hạn 7 ngày.

3. Hoàn tiền B2B

Hoàn tiền cho đăng ký B2B (giới hạn $999/tháng/trường) được đánh giá trên cơ sở từng trường hợp. Trường học và tổ chức nên liên hệ support@vietspeaks.com để thảo luận về yêu cầu hoàn tiền. Hoàn tiền một phần có thể có sẵn cho đăng ký hàng năm trong một số trường hợp nhất định.

4. Cách Yêu cầu Hoàn tiền

Liên hệ support@vietspeaks.com với chi tiết đơn hàng của bạn, bao gồm địa chỉ email và lý do yêu cầu hoàn tiền. Chúng tôi cố gắng phản hồi trong vòng 3-5 ngày làm việc.

5. Thay đổi Chính sách

Chúng tôi có thể cập nhật chính sách này để phù hợp với điều khoản của Dodo Payments và các quy định áp dụng; việc tiếp tục sử dụng cấu thành sự chấp nhận.
